Terms of Use
These terms govern the use of the Belgian Mobility Open Data Portal and its datasets. Please read them carefully before accessing our services.
Last updated: December 15, 2024
Effective date: January 1, 2025
1. Purpose
These Terms of Use (ToU) define the conditions for accessing and using datasets made available by the Belgian Public Transport Operators (hereinafter the "PTOs", namely STIB-MIVB, De Lijn, TEC and SNCB-NMBS) through the Belgian Mobility Company (hereinafter "BMC") Open Data Platform (hereinafter "the Platform").
2. Scope
These terms apply to any person or entity (hereinafter the "User") accessing or reusing the datasets published on the Platform.
By accessing the data, the User acknowledges having read, understood, and accepted these Terms of Use.
3. Applicable License
Unless otherwise stated, all datasets on this Platform are made available under the following license:
Creative Commons Attribution 4.0 International (CC BY 4.0)
In the context of this Open-Data Portal, each Public Transport Operator (PTO) remains the sole Licensor of the datasets it publishes on the Platform. The Belgian Mobility Company (BMC) acts as the technical operator of the Platform, not as a Licensor.
This license allows free reuse β including commercial β provided that attribution is given, as detailed in Article 4 below.
4. Attribution
Any reuse of data must include, at a minimum, the following attribution:
Source: [PTO Name] β Open Data β [Date of dataset update]
If the data is modified or adapted, the following attribution is recommended:
Contains data originally published by [PTO Name], modified by [User Name].
5. Data Access Conditions
The Platform is freely accessible according to the following usage tiers:
| Access Tier | Registration Required | Usage Quota (indicative) | Intended Users |
|---|---|---|---|
| Anonymous | β No | 100 requests/day 10/minute |
General public, testing |
| Standard | β Yes | 10,000/day 500/minute |
Developers, NGOs, startups |
| Gold | β + SLA | Upon request | High-volume Platforms |
Please note the following:
- Bandwidth and rate limits may be applied at any time to ensure system stability. If limits are exceeded, HTTP 429 (Too Many Requests) errors may be returned.
- The Anonymous and Standard Access Tiers are not covered by any Service Level Agreement.
- If access to the datasets is granted through an API key, the following conditions apply:
- The API key is personal and non-transferable. It may only be used by the registered User to whom it was assigned.
- The User agrees not to share, disclose, or transfer their API key to any third party, whether an individual or organization.
- The User is solely responsible for any use of their API key, including by unauthorized parties if the key has been shared or compromised.
- In the event of suspected misuse or compromise of the API key, the User must notify BMC without delay.
- Violation of this clause may result in immediate suspension or termination of access, without prejudice to other remedies available under these Terms of Use.
- Escalation Path: Users start with Standard, can request Gold via service agreement. On top of the public Terms of Use, the service agreement offers higher quotas and clarifies liability and support agreement.
- BMC reserves the right to charge fees for Gold tier access where high-volume use causes substantial infrastructure costs. Such fees will be defined transparently in the service agreement.
6. Disclaimer of Liability
The data is licensed under CC BY 4.0, including a full disclaimer of warranty and liability. The licensor makes no guarantees as to the accuracy, completeness or continuous availability of the data.
7. Personal Data
No personal data are collected when accessing or consulting publicly available datasets on the Platform.
Personal data are only collected when the User registers (signs up) to obtain a personalized access level (e.g. to receive an API key). In this case, BMC may collect limited contact information necessary to manage the account.
Any processing of personal data is carried out in accordance with applicable data protection laws and BMCβs Privacy Policy, which explains the purposes of processing, legal bases, retention periods and usersβ rights.
Users who do not register are not subject to any personal data collection.
8. Modifications to the Terms
BMC reserves the right to amend these Terms of Use at any time.
Users will be informed of any changes via the Platform. Continued use of the data implies acceptance of the updated terms.
9. Termination of Access
BMC reserves the right to suspend or revoke access to any user in case of a clear violation of these ToU or any attempt to compromise the service's availability or integrity.
10. Governing Law and Jurisdiction
These Terms of Use are governed by Belgian law.
Any dispute relating to their interpretation or enforcement falls under the exclusive jurisdiction of the courts of Brussels.
